If you have been injured in a car crash through no fault of your own, then you may be eligible for compensation. There are two main criteria you need to be aware of before you make a claim for compensation, in order to ascertain your eligibility.

Three year limit

The first criteria is time-based. Your case will have what is called a Date of Limitation. This Date must be no more than three years ago. The three years starts from the date your accident happened, or the date your injuries became clear. After three years, unfortunately you may not be able to bring your claim forward with Nationwide Injury Lawyers, because your case will be time-barred or statute barred under UK law.

If you were a minor at the time of your accident, then you have three years from the date of your 18th birthday to claim. The three year limit can sometimes to be extended under exceptional circumstances, so seek legal advice as soon as possible.

Your level of liability

Compensation is available to all victims of accidents who were injured as a result of somebody else’s actions. Your level of liability cannot be 100 per cent to make a claim. Or in other words, if you were wholly responsible for your accident happening, then you will have no grounds for making a claim. In addition, the other side will be under no obligation to pay you compensation under the circumstances.
