There are over 4 billion passenger journeys on busses every year in the United Kingdom and while most are trouble-free, some do result in accidents.

If you have been injured in a bus accident, your eligibility for making a claim for compensation depends on two main factors. It will also need to be proven that you were injured on said bus at said time through an investigative process.

  1. The date your accident happened

There is a time limit to which you can bring a compensation for bus accident claim forward, and that time limit is three years from the date your accident happened or from the date that your injuries became clear. This is known in the legal industry as your Date of Limitation or your Date of Knowledge. After three years, unfortunately most personal injury claims are time-barred or statute barred, preventing you from bringing them forward.

  1. How your accident happened

While this is unlikely to be the case with a bus accident, to claim compensation for bus accident you cannot be wholly liable for the accident in which you were injured. So to give you an extreme example, if you grabbed the bus driver’s steering wheel and the bus crashed and you were injured, you will be 100 per cent liable for the accident. To make a claim, you can only be partially responsible, and the lesser your liability the stronger your claim will be.

What if I was under 18 at the time of my accident?

Anyone under the age of 18 is classed as a minor under UK law. If you were injured in a bus accident when under the age of 18, you have three years from the date of your 18th birthday to make a compensation for bus accident claim. Or if you are the parent or legal guardian of a minor injured in a bus accident, you can make a claim on their behalf as the ‘litigation friend’. You should seek specialist legal advice if this applies to you.

How long will it take for me to get my compensation?

There are no guarantees that you will get any compensation for your injuries; your lawyer first has to prove that you were not at fault. Providing your case is easy to process, our lawyers may be able to win you compensation within just 6-8 weeks. However more complex cases may take several months to process, with a lot depending on the other side.
