Do you have a medical negligence claim?

Medical negligence, otherwise known as clinical negligence, is a breach in the duty of care that healthcare professionals have for their patients.

It is a general term used to describe a wide variety of scenarios, in which a patient is left injured or otherwise ill as a result of another person’s actions, which in this case could be a cardiologist, an anaesthetist, a general practitioner or a surgeon.

If you have gone into surgery and you have suffered afterwards, or you have received another form of medical treatment which has left you injured, then you may be eligible for compensation. Your eligibility under the circumstances depends on two factors:

  1. When the negligence took place: The date you were injured or the date your injuries first became clear can be no more than three years ago. This is because under the Limitation Act 1980 after three years most medical negligence claims become time-barred or statute barred, preventing you from bringing them forward.
  2. Your level of liability: It is unlikely to be the case that you are in any way liable for your injuries in a clinical negligence claim, however it will still have to be shown by your lawyer that you have a level of diminished liability in order for your claim to be accepted and for you to be eligible for medical negligence compensation.

Providing you meet these basic criteria, then it is likely you are eligible for compensation.

What can I make a claim for?

Most medical negligence claims are for cosmetic surgery issues, dental surgery issues, incorrect anaesthesia and infection following surgery or treatment. However, you can make a claim for any injury or illness you have sustained, providing that it was caused by somebody else’s actions or inactions. You can also make a claim whether your treatment was with the NHS or through a private medical organisation.
