What is ‘No Win, No fee’?
No win, no fee agreements, or Conditional Fee Agreements to give them their proper name, were introduced into courts in the United Kingdom in 1995.
No win, no fee was introduced so that everybody could get access to justice, no matter their status or wealth, if they were injured through no fault of their own. No win, no fee is now the most common type of client-solicitor agreement in personal injury law.
Under a no win, no fee agreement, the claimant has no legal fees to pay upfront nor during the claims process. Legal advice and representation is provided at no upfront or rolling cost to the claimant. Instead, no win no fee lawyers get paid only if their case wins. Under the circumstances, the lawyer can recover their costs from the other side, or they can take a maximum 25 per cent of the final compensation figure as payment.
The only downside to ‘no win, no fee’ is that the claimant can be billed by the other side if their cases loses. To remedy this, practically all reputable law firms require their client to take out an insurance policy to protect them from this eventuality.
