If you have been injured in a car accident through no fault of your own, then you may be eligible for compensation. You can make a claim whether you were driving for leisure or to a place of work at the time, or even if you were a passenger in the vehicle.
Your eligibility for making a claim for depends on when your accident happened, and how your accident happened. Details on these eligibility criteria can be found below:
You only have three years from the date your accident happened to make a claim, or three years from the date your injuries became clear. Under UK law after three years most personal injury claims are statute barred. We say most, because it is sometimes possible to extend this time limit, but only under exceptional circumstances. If you were a minor at the time of your accident, you have three years from the date of your 18th birthday to claim.
Your level of liability
You cannot be 100 per cent liable for the accident in which you were injured. If you are completely liable, the other side will be under no obligation to pay you compensation, and it is highly unlikely that a law firm or first injury lawyers will even take on your case. You can however be partially responsible, up to 75 per cent. The greater your level of liability is, then generally speaking the lower your pay-out will be.
How long does the claims process take?
The easier it is to prove that you were not at fault for your accident, then generally speaking the quicker the claims process will be. However, as any first injury lawyers would tell you, a lot also depends on the efficiency of the other side. Some insurers are very slow to respond to claims. However from start to finish, most claims can be processed in 6-8 weeks. Complex claims can take a few months to process; you should ask your lawyer for a better estimate.
Can I make a claim if I was injured in a private hire vehicle?
Yes. Under the circumstances, your claim will likely be with the other party’s insurer, or with the private hire company’s insurer. If neither of these are options for you, then it may be possible to make a claim with the Motor Insurers’ Bureau. Whatever the case, you will be able to make a claim for financial compensation with first injury lawyers.
