Expert Whiplash Advice

If you have suffered whiplash in a car accident that was not your fault, then you may be eligible for financial compensation with an injury claim expert.

Whiplash is a debilitating injury and it is in fact the most common injury sustained in car accidents. It is caused by a sudden jerk or jolt to the head usually as a result of the collision itself, however air bags can also cause whiplash. The only symptom of whiplash is usually pain however more serious cases show musculoskeletal and neurological symptoms.

If you have suffered whiplash, then you may be able to make a claim. Your eligibility under the circumstances relies on two key facts, which are:

  1. Your level of liability: To be eligible for compensation you cannot be wholly responsible for the accident in which you were injured. You must have a level of diminished liability. This is because under UK law, the other side will be under no obligation to pay you compensation if they are not liable.
  2. When your accident happened: To be eligible for compensation the accident in which you were injured must have occurred no more than three years ago. After three years, your claim will be statute barred under the Limitation Act 1980 which will prevent you or an injury claim expert from bringing it forward.

So long as the accident was not wholly your fault and it happened less than three years ago, then we would say that there is a good chance you are eligible for compensation.

How much compensation could an injury claim expert win for me?

This depends on the extent of your whiplash injuries, and how your injuries have and will affect your life. The worse your whiplash is, and the bigger the impact they will have on your personal and professional life, then the more compensation you can realistically expect. As part of the claims process you will attend a medical examination to establish these facts and this report will be used to form the basis of your settlement demand.

Whiplash is usually graded on a scale of 1 to 3 with 1 being minor, 2 being moderate and 3 being severe. Your injury claim expert will compare your injuries to past cases and establish a fair and proportionate settlement figure for you. This may be a few thousand pounds, or in the case of severe whiplash it may be tens of thousands of pounds.
