Do I have an injury claim?
If you have been injured in an accident through no fault of your own, or you believe that you were only partly responsible for the accident, then you may have an injury claim. To be eligible for compensation, you must have a level of diminished liability.
Providing this is the case, then the last eligibility criteria you need to be aware of is the limitation period imposed on personal injury claims under the Limitation Act 1980.
Under the Act, you only have three years from the date your accident happened or from the date your injuries first became clear to make a claim. This is known as your Date of Limitation or your Date of Knowledge. After three years, personal injury claims become statute barred or time-barred. The limitation period can be extended under exceptional circumstances, however, and exclusions do apply to those treated under the Mental Health Act 1983.
